Accordingly we were satisfied that ARIBASAN and TIGGER TAHNEE were denied fair starts due to mechanical failure of the starting gates and pursuant to Rule 632 the Judicial Committee declared those horses to be non-starters.
Facts:
Following the running of Race 1, the Windsor Park Stallions Sprint, Mr Neal lodged an information requesting a ruling in relation to Rule 632 to determine whether ARIBASAN and TIGGER TAHNEE received a fair start.
Rule 632 reads: If, in the opinion of the Judicial Committee, a horse which does not finish in the first three placings was prevented from taking an effective part in a Race owing to mechanical failure of starting stalls, or is denied a fair start and such occurrence materially prejudiced the chances of that horse (but not where the horse is slow away by its own accord), the Judicial Committee may declare such horse to be a non-starter.
Submissions for Decision:
Race 1 was run over 1300m with TIGGER TAHNEE starting from barrier 9 and ARIBASAN from barrier 10. Mr Neal had Mr Oatham show the head-on video of the start of the race. With the film played at slow speed it was obvious that gates 9 and 10 both failed to open at the same time as the remainder. Mr Bradley explained that after his gate was slow his mount TIGGER TAHNEE jumped outwards and impeded the progress of ARIBASAN. He said that while he lost quite a bit of ground he was not convinced that it affected his chances of finishing in a better position.
Ms Goldsbury also confirmed her gate was slow and stated that as a consequence she was placed further back in the field than intended. She said the slow start may have affected her chances. The trainers of both horses said that due to the gates being slow their horses settled further back in the running than they would have liked.
Mr Neal said while it was impossible to predict where each horse would have finished the fact was that they were both denied a fair start due to the gates being slow to open.
Reasons for Decision:
The Judicial Committee carefully considered all of the submissions. The head-on film was conclusive and showed the two affected gates closed while the others were open. Ms Grant and Mr Evans, the respective trainers, outlined their race plans and indicated a preference for racing handier in the field. Taking into account the amount of ground lost at the start it was likely that the chances of each horse were materially prejudiced. We note that neither horse finished in the first three placings.
