The protest was upheld and FILIGREE SHEREE was disqualified from the race. Consequent upon the disqualification, the amended placings for the race are as follows:

1st   9  Xmas Joyella
2nd  4  Mantorp
3rd   7  Springfield Eyre
4th 10  Total Exposure
5th 13  Luther Vandross

It was ordered that dividends and stakes be paid in accordance with that amended result.

Facts:

Following the running of Race 1, Monarchy Trot, an information instigating a protest was filed by Stipendiary Steward, Mr S W Wallis, against FILIGREE SHEREE (A J Tomlinson), placed 4th by the judge, on the ground that it “broke in excess of 150 metres during the running”.

Mr Ford was not present at the hearing of the information, but he had endorsed and signed the information to the effect that he did not contest the protest. Mr Wallis confirmed that Mr Ford did not wish to be present or contest the protest.

Rule 870 provides as follows:

(3) Any horse which breaks from its gait shall promptly regain its proper gait.

The Breaking Horses Regulation provides as follows:

For the avoidance of doubt and in order to clarify the situation for all parties concerned, the following shall apply with regard to breaking horses:

(a) Any horse which breaks from its gait either at the start or during the running of any race metres of any race and continues on in the break for a distance of 150 metres or greater, shall be deemed to be in breach of Rule 870 (3) in that it has failed to promptly regain its proper gait.

Where a protest has been duly lodged against the placing of an offending horse, the Judicial Committee shall either:

(i) relegate such horse under Rule 870 (4) to behind any other horse in respect of which an advantage may have been gained; or

(ii) disqualify it from the race under Rule 1003 (2).

Submissions for Decision:

Mr Wallis showed a video replay the first 400 metres of the race, a standing start trot for non-winners over 2600 metres. He pointed out FILIGREE SHEREE, driven by Mrs Tomlinson, which had drawn 1 on the front row, pace for a couple of strides and then go into a gallop after approximately 100 metres, when leading the field. The horse then continued on in a gallop for some distance, well in excess of 150 metres, before regaining its proper gait and eventually finishing in 4th placing. 

Reasons for Decision:

The Committee was satisfied that FILIGREE SHEREE had broken from its gait during the running of the race and had continued on in a gallop for a distance in excess of 150 metres in breach of Rule 870 (3) and the Breaking Horses Regulation in that it had failed to promptly regain its proper gait The Committee also noted that Mr Ford did not contest the protest.
