The films clearly showed that ‘SUNSOON’ broke and galloped the final 100 metres. Horse 8 ‘SUNSOON’ was disqualified. Placings now to read 10 – 3 – 9 – 7 – 12 – 4 and authority to pay out on the amended placings was given.
Facts:
Following the running of race one, a protest was lodged by the steward requesting a ruling brought under rule 870 in that horse 8 ‘SUNSOON’, provisionally placed 4th by the judge, galloped the last 100 metres.
The placings as called by the judge initially were:
10 CHARLEMAGNE - 1st
3 RARANGI JEWEL - 2nd
9 MONARO MITE - 3rd
8 SUNSOON - 4th
7 DOCTOR ZHIVAGO - 5th
12 ELEGANT SUN - 6th
Mr Muirhead, using the available films, informed the committee that ‘SUNSOON’ broke in the run to the line and galloped the last 100 metres. He asked for the disqualification of ‘SUNSOON’ under rule 870. The trainer of 'SUNSOON', Mr Rochford, viewed the film and concurred with the stewards that his horse galloped the final 100 metres.
