Facts:
Following race 1 an information was filed pursuant to rule 638 (3) (b). The informant Mr A Coles alleged that Mr M Gillies, rider of BRICK HOUSE, used his whip in a manner deemed to be excessive.
Submissions for Decision:
Mr Williamson demonstrated the video films which showed Mr Gillies striking his mount BRICK HOUSE approximately 11 times before the 200 metres. He said Mr Gillies did not give his mount the required respite as set down in the whip guidelines. Mr Williamson said it was also of concern that Mr Gillies continued hitting his mount after the 200 metres when it was obviously well beaten.
Mr Gillies in admitting the breach said he had been told to ride his mount aggressively but had taken these instructions to the extreme.
Submissions for Penalty:
Mr Coles said Mr Gillies had a clear record in the preceeding 12 months. However it certainly was not the worst case he had seen and because Mr Gillies had an excellent record, submitted a fine at the low end would be appropriate.
Mr Gillies had nothing to say regarding penalty.
Reasons for Penalty:
The Committee considered all evidence and submissions as presented. Mitigating factors are Mr Gillies admission of the breach and his outstanding record. However in this case Mr Gillies did not comply with the whip guidelines and as the committee explained to him the unnecessary hitting of a horse when it is well beaten is not acceptable.
