Ms Wynne is suspended from riding from the end of racing on Sunday 29 November 2015 up to and including 9 December 2015. This is four Central District/South Island race days. Ms Wynne is reminded of her professional obligations and, in particular, with respect to the careless riding rule.
Facts:
Mr Davidson alleged that in Race 8 the BP2Go Cromwell Rating 65 1220, Ms Wynne permitted her mount Rapt to shift outwards passing the 300m causing All Dressed Up (S Muniandy) to check.
Mr Davidson demonstrated on the videos that at a point close to the apex of the turn leading into the home straight, Ms Wynne shifted from a one out position following Tinka Tinka (D Walsh) and moved 1-2 horse widths to the outside causing interference with All Dressed Up.
Ms Wynne explained that she had made an instinctive decision to move outwards as her mount was travelling very well whereas Tinka Tinka was starting to tire in front of her. In her words she overreacted and in attempting to move outwards, moved out too far thereby causing interference with All Dressed Up. Ms Wynne noted that had she stayed where she was Rapt would have had a very good and clear run in the straight.
Mr Harris emphasized that Ms Wynne’s actions were more poor execution than true or classic carelessness and that had she moved only one width outwards there would have been no interference at all. Ms Wynne is the leading apprentice jockey in the country and Mr Harris noted that there is a fine line between competitive riding and careless riding at times, which Mr Davidson did not disagree with. This was a split second decision to move which Ms Wynne did not execute properly. Mr Harris accepted though that there had been interference and that the charge was made out.
Submissions for Penalty:
Mr Davidson described the breach as mid to low range. Mr Davidson stated that Ms Wynne was a South Island jockey who rode regularly in the Central Districts, such that she could be considered a Central District’s rider. Mr Davidson recited Ms Wynne’s record over the past 12 months which has included four suspensions, namely a five day suspension in January at Westland, a three day suspension at Riverton in May, a three day suspension at Oamaru in July and a four day suspension at Wingatui in October. Mr Davidson submitted that a suspension in the order of four days would be appropriate and that it ought not to have more than two South Island days included in its dates.
Mr Harris made submissions on Ms Wynne’s behalf as to the penalty and indicated that he could not disagree with much of what Mr Davidson had said. He emphasized to the committee that this was a leading apprentice jockey whose record was not poor, rather it was average by comparison with other apprentice jockeys. Mr Harris noted that otherwise this was an apprentice jockey with a bright future and in fact one who was going to take on further riding in the North Island if possible. No deferment of suspension was sought as Ms Wynne would like to ride at the forthcoming Southland meeting. Mr Harris asked for leniency given Ms Wynne’s prospects.

Ms Wynne’s prior record of careless riding does her no favours but we have determined to treat her record as a neutral factor on this occasion. There will be no uplift. Ms Wynne is entitled to credit for her admission and to reflect the low level carelessness involved here. That credit will be one day.
