Decision:

As Mr Riddell admitted the breach we found the charge proved.

Penalty:

The Committee took into account Mr Riddell’s upcoming riding commitments and accordingly suspend his license from the close of racing on Saturday 8th September up to and including racing on Friday September 21st.

Facts:

Following the running of Race 1(Redwood Trophy 2000m) an Information was lodged by Mr J Oatham alleging a breach of Rule 638(1)(d) in that Jockey, J Riddell allowed his mount LOOK OUT to shift inwards approaching the 1600m when not sufficiently clear of THE COSSACK which was checked.

Mr Oatham had Mr Goodwin explain the incident with the assistance of the available films. Mr Goodwin said passing the winning post, on the first occasion, Mr Riddell was attempting to gain a run closer to the running rail. On the bend, when not sufficiently clear of Mr Harris (THE COSSACK), Mr Riddell allowed his mount to shift in. As a result, Mr Harris had to take evasive action for several strides. His mount went back onto two other runners, DONARDO and LOTHBROK.

Mr Riddell admitted the breach and said he had shaved Mr Harris a bit short by cutting the corner too tightly. He said that Mr Harris’ mount didn’t help itself by throwing its head around and had overreacted.

Mr Oatham presented Mr Riddell’s riding record for breaches of the careless riding rule:

He said this record was high compared with most other riders’ records over a twelve-month period. Mr Oatham said the Stewards considered Mr Riddell’s carelessness to be below mid-range and submitted that a suspension in line with that would be an appropriate penalty.

When invited to make submissions on penalty Mr Riddell told the Committee that his previous breaches had all been low range carelessness. He said unlike some of the other riders who took the winter off riding, he slogged it out, therefore his record was not too bad. He believed today’s breach was a lack of concentration, a minor lapse, and he should have ridden his mount forward before shifting ground.  He advised of riding commitments through until after next Saturday.

Reasons for Penalty:

In coming to a decision on penalty the Committee first considered the degree of carelessness. Mr Riddell clearly shifted inwards when only a bare length clear of THE COSSACK which received a relatively bad check. As a consequence, two trailing horses also suffered interference. We do not agree with Mr Riddell’s assertion that THE COSSACK overreacted when getting its head up. In our opinion this was only due to the nature of the check. The Committee placed the degree of carelessness at no less than mid-range. We therefore adopted a starting point of 8 days suspension as outlined in the Penalty Guide for Judicial Committees.

An aggravating factor is Mr Riddell’s poor record. This is his 6th charge of careless riding since January 2018 (over approximately 264 rides) which gave us reason for concern.

The only mitigating factor was his admission of the breach.

Balancing up all the factors outlined above we determined that an appropriate penalty was one of 9 riding days.
