Facts:
Following the running of Race 6, XCM Sport Trot, an information was filed by Stipendiary Steward, Mr S P Renault, against Licensed Junior Driver, Miss S J Ottley, alleging a breach of Rule 869 (3) (b) in that Miss Ottley, as the driver of WISHES STAR in the race, “shifted ground inwards near the 2300 metres when not clear of MIDFREW MEDUSA (B Thomas) which broke and lost ground”.
Miss Ottley had signed the Statement by the Respondent on the information form indicating that she admitted the breach. Mr Renault informed the Committee that Miss Ottley did not wish to be present. She had admitted the breach after viewing the video replays with Mr K M Barron, Licensed Open Horseman, Mr Renault said.
Rule 869 provides as follows:
(3) No horseman in any race shall drive:-
(b) carelessly.
Mr Renault showed video replays of the relevant part of the race, as the leaders raced to the first bend some 300 metres after the start of the 2600 metres standing start event. He pointed out Miss Ottley, driving WISHES STAR, racing in 2nd position. He pointed out MIDFREW MEDUSA (B Thomas) racing in 5th place on the markers.
Mr Renault said that, racing into the bend, Miss Ottley attempted to go into the trail behind the leader, TRICK STAR (T M McMillan). Mr Thomas had improved up the inside and was established on the inside of Miss Ottley. Miss Ottley directed her horse inwards but realised, too late, that Mr Thomas was inside her. She attempted to pull out but Mr Thomas had had to take a hold of his horse, which broke and lost its position, finishing 3-back on the markers. There was no actual contact, Mr Renault said, but Mr Thomas had been tightened and had to take a hold of his horse, which broke.

Mr Renault told the Committee that Miss Ottley is the leading Junior Driver. She has 93 drives in the current season and, in the 2012/2013 season, had 301 drives. She is a very busy driver, Mr Renault said. She has a clear record in the last 12 months.
The breach was at the lower end of the scale, Mr Renault submitted. He submitted that, having regard to her junior driver status, a fine of $200 was appropriate.
Reasons for Penalty:
In determining penalty, the Committee had regard to the starting point in the Penalty Guide of a $300 fine. Mitigating factors were Miss Ottley’s admission of the breach, her previous excellent record and that the breach was at the lower end of the scale. Miss Ottley had made an error of judgement and, when she realised this, took immediate corrective action. The consequences to Mr Thomas’ horse were not serious.
