We find the charge proved.
Penalty:
Mr Bradley you are fined the sum of $400.

Alledged breach of rule 636 (1) (c).
Facts:
Mr. D. Bradley did not admit a breach of rule 636 (1) (c) in that he relaxed his ride over the final stages on Turkish Gold when competing for 5th. The margin between 5th and 6th was a neck.
Submissions for Decision:
Mr Neal using the three available films indicated to the committee that approximately 4 – 5 strides short of the winning post Mr. Bradley stopped riding and put his whip away allowing the horse coming down the outside ‘Foxtonion’ to run past. The horse Turkish Gold was well tried in the straight and there was no impediment not to ride out. He submitted that the only people financially affected by his actions were the owners as the horse finished outside a dividend bearing position. He reiterated the rule 636 (1) (c) stressing that a rider much ride his horse out to the end of the race if there is a reasonable chance of it running into a position for which there is prize money to be awarded, in this case $175.
Mr Bradley submitted that it was the horse's first run since 28 June and it had no trials. He was travelling behind the leaders and felt it could possibly run into the minor dividend bearing position. He believed his mount gradually weakended and that he was about 4 lengths from the runner up. He submitted that the films could be classed as deceptive and he believed that Foxtonian was ahead of his mount when he put the stick away.
Mr Neal commented that he was not in the position to debate who was in front short of the post it was Mr. Bradley’s duty to ride his mount out which the films clearly showed he didn’t.
Reasons for Decision:
Mr Bradley, in coming to our decision to find the charge proven we revisited rule 636 (1) (c). All available films clearly show that 4 – 5 strides short of the post you put your whip away and certainly did not show any vigour on your mount in the run to the line. In your submissions you informed the committee that you were headed by Foxtonian at the time you stopped riding. We have carefully considered that part of your submission and are unable to agree with those particular comments. The rule states quite clearly that a horse must be ridden out to the end of the race if there is a reasonable chance of it running into a position for which there is prize money to be awarded, in this particular incident Mr Bradley that obligation was not fulfilled.
Submissions for Penalty:
Mr Neal submitted that he believed this breach would be best served by way of a fine. He informed the committee that Mr Bradley has had two charges under this particular rule on the 25 October 2010 at Woodville and 2007 at Winton. He confirmed that this charge was brought under a different subsection rule to a charge Mr Bradley had incurred at Wanganui on 20 October this year. In this particular incident the only financial imposition was to the connections of the horse concerned (the stake money was $175). The betting public were not affected. He asked that any monetary penalty imposed should start at a minimum of $200. Mr Bradley was a senior rider with a long and impressive riding record.
Mr Bradley had no comment.
Reasons for Penalty:
Mr Bradley we have carefully considered the submissions on penalty placed before us. We concur with both parties that in this particular incident only the connections suffered financially, they lost stake money. As a senior rider with many years of experience you have a responsibility to ride within the rules. This racing industry expects better and deserves better. Your actions in not fulfilling your obligation to give your mount a reasonable chance of finishing in a higher position did not look good.
