As Mr Turner admitted the breach we found the charge proved.

Facts:
Following the running of Race 8, Bonecrusher New Zealand Stakes, Group 1, an Information was lodged by Mr Oatham under Rule 638(1) (d) in that Dylan Turner allowed (GIRL OF MY DREAMS) to shift out when not clear crowding (CONSENSUS) near the 150 metres.
Although the videos had been viewed several times during the protest hearing they were played again focussing on the careless riding charge relating to Mr Turner. Mr Williamson said Mr Turner allowed GIRL OF MY DREAMS to shift outwards 3 – 4 horse widths, while under pressure, forcing CONSENSUS onto the hindquarters of VOLKSTOK’N’BARRELL and hampering that runner. Mr Williamson said this initiated the laying in of VOLKSTOK’N’BARRELL onto GIRL OF MY DREAMS which caused further interference. Mr Williamson estimated Mr Turner to be only ½ length in front of CONSENSUS when he shifted outwards.
Mr Turner conceded that he had moved out but said as soon as contact was made he stopped riding and straightened his mount up.
Submissions for Penalty:
Mr Oatham produced Mr Turner’s riding record for the previous 12 months which showed one careless riding charge in December 2015 at Taranaki. He has recently completed his apprenticeship, transitioning to a senior rider, in February this year. Mr Oatham submitted that Mr Turner had readily admitted the breach and his record was good. While the interference suffered by CONSENSUS was relatively severe it had been caused by the actions of two different horses, not only Mr Turner’s mount. Mr Oatham commented further, that although CONSENSUS had its chances in the race compromised, it was the opinion of the Stewards that third placing was probably where it would have finished. He said this did not ignore the fact that CONSENSUS was entitled to a clear run to the line.
Mr Turner had no further submissions to make on penalty, other than he had straightened up as soon as contact had been made with CONSENSUS. He advised of riding commitments through until Wednesday next week.
Reasons for Penalty:
In coming to a decision on penalty the committee adopted, as a starting point, a five day suspension as outlined in the Judicial Committee Penalty Guide. Aggravating factors were the Group 1 status of the race, the $200,000 stake money on offer and the consequences of Mr Turner’s carelessness in regard to the interference suffered by CONSENSUS. For this we applied an uplift of three days to take the number of days to eight.
Although we placed the consequences of Mr Turner’s carelessness in the mid-range we assessed his degree of carelessness to be in the low to mid-range. Mr Turner could be seen to take prompt corrective action as soon as he made contact with CONSENSUS. We also had regard to the contribution of VOLKSTOK’N’BARRELL to the incident. Other mitigating factors were Mr Turner’s admission of the breach and his very good record for which we allowed a two day discount.
The Committee asked Mr Turner if he had a recent history of riding midweek in the Northern region. Both he and Mr Oatham provided several examples where he had done so therefore his suspension was calculated with all North Island days included.
