As Mr Scaife has admitted the breach of the Rule the charge is proved.

Charge:

Following the running of Race 2 Information A5069 was filed by Stipendiary Steward Mr S Renault under Rule 865(2). The information said that P Scaife "failed to notify that "Motu Belloftheball" would not be racing with blinds on". Mr Scaife indicated on the information that he admitted the breach of the Rule and that he did not wish to be present during the hearing. Breaches of Rule 865(2) are considered a Minor Infringement but as this was Mr Scaife's third breach of the Rule in the previous 12 months the Stipendiary Stewards requested a hearing be held to determine penalty.

Facts:

Mr Renault said that "Motu Belleoftheball" came into the birdcage wearing the previously notified removeable deafners but not wearing the also notified blinds. He said that when Mr Scaife had been spoken to about the matter he said he had simply forgot to put them on.

Mr Renault said that this was Mr Scaife's third breach of this Rule in the previous 12 months - the earlier breaches being on 21 January 2011 and the latest on 29 December 2011. He submitted a fine of $200 was an appropriate penalty in this case.
