Facts:
Following Race 2 a protest was lodged by Stipendiary Steward Mr S Wallis on behalf of the connections of Horse 3 Dauntless driven by Mr B Edwards placed third by the judge, and Horse 9 Springfield Legacy driven by Mr J Stormont placed 10th by the Judge against Horse 4 ITSNOWORNEVER driven by Miss N Chilcott placed 2nd by the judge on the grounds that it caused interference with approximately 1000 metres to run.
Mr Wallis referred the hearing to video footage of the relevant stage of the race and identified the respective runners.
Submissions for Decision:
Mr Wallis told the committee that Miss Chilcott on Itsnowornever went to the lead near the 1000 metre mark and eased down in front of Dauntless driven by Mr Edwards. Dauntless broke but recovered to run into third place.
Mr Edwards said that as Miss Chilcott eased Itsnowornever down onto the running line his horse hit her sulky wheel. Using the video footage he indicated the point at which he said contact was made.
Miss Chilcott said there was no contact between the two horses and claimed she was in the best position to see if there had been. She was always clear of Dauntless and she believed that Dauntless took fright when her horse came across.
Mr Branch said it was clear from the footage that there was no contact with the wheel of Itsnowornever.
Reasons for Decision:
The Committee listened to the submissions from all parties and reviewed video footage of the relevant stage of the race.
There was no evidence to show that there had been any contact made between the feet of Dauntless and the Sulky wheel of any other part of the horse Itsnowornever. The available evidence supported the contention of the connections of Itsnowornever that there had been no interference caused and that Dauntless had broken free of interference when it was being crossed.
