Facts:
Mr Larsen (A ROCKNROLL MAID) was charged with Careless driving - r 869 (3) (b), in that he shifted ground shortly after the start causing interference to MAGNETIC CHIME.
Mr Larsen admitted the charge.
Ms Haley pointed out the relevant positions of A ROCKNROLL MAID and MAGNETIC CHIME at the start with the use of the video. A ROCKNROLL MAID and MAGNETIC CHIME drew six (front line) and four (second line) respectively. Approximately 200 metres after the start A ROCKNROLL MAID was trailing MAHIA in a three wide position.
Mr Munro stated as MAHIA (MP Jones) was restrained from a three-out position to take a trail two-out Mr Larsen shifted inwards and in doing so MAGNETIC CHIME was cramped for room. Mr Beck was forced to restrain MAGNETIC CHIME which paced roughly for several strides and losing several lengths.
Mr Larsen stated that when Mr Jones restrained MAHIA he considered staying out three-wide, but then changed his mind and shifted inwards. He said it was a case of people shifting positions as the field entered the first bend. He had not realised there was another runner on the inside of Mr Beck.

Mr Munro stated Mr Larsen had an excellent record with no previous breaches of any rule inside the past 12 months. He had had 85 drives last season and 18 drives to date this season. He viewed the interference at the low end of the scale. He sought a fine of $500 or a 10 drive suspension.
Mr Larsen said he had confirmed drives at Central Otago (2nd January). He preferred a suspension as opposed to a fine and did not ask for a deferment of penalty.
