Ms Moore admitted the breach, which we thus find proved.

Penalty:

Ms Moore is suspended from riding from the end of racing today up to and including 18 December. This is one day shy of 3 weeks and is in effect 3 South Island days.

Mr Neal charged Ms B Moore with a breach of rule 647(1) in that she had failed to weigh-in in race 7 as required by that rule

Submissions for Penalty:

Mr Neal stated PEYOW PEYOW had finished 4th. Ms Moore was required to weigh-in but she had omitted to do so. He stated that although Ms Moore had been distracted, the onus was on her as the rider of PEYOW PEYOW to weigh-in. He acknowledged it had been a busy birdcage and there were no club stewards to assist with the weighing-in. He said Ms Moore had had 126 rides in total, and 30 since she had come back after injury.

Mr Neal submitted that a starting point of 3 weeks’ suspension was appropriate and, in so doing, he drew a comparison with recent cases under this rule.

Ms Moore explained that she had 7 rides today, which was the most she had ever had on the one day. She openly admitted that she had forgotten to weigh-in because of the need to provide her saddle to a trainer so he could saddle her mount in the next race.

Mr Pitman said Ms Moore was an extremely promising apprentice of limited experience. He said both he and Ms Moore accepted that there was no excuse for her momentary lapse of judgment. He asked for the period of suspension to be as short as possible, emphasising that apprentices learn by competing.

Reasons for Penalty:

Ms Moore is a relatively inexperienced apprentice with only 126 rides over a 2 1/2 year period. We accept there were no birdcage stewards to assist with weighing-in and note that the birdcage has been very busy today. There is, however, no excuse for Ms Moore’s lapse, which has cost the connections and those who invested on the horse on the First 4. PEYOW PEYOW was disqualified from 4th placing.

We take a starting point of 3 weeks and find we can give only limited credit for Ms Moore’s relative inexperience, clear remorse and good record.
