The committee determined that Thunderbird One and Miss Pelear be declared non-starters.
Facts:
Following the running of Race 8 The Makfi Challenge Stakes Information A3268 was filed with the Judicial Committee requesting a ruling. The information asked that the Judicial Committee determine whether Thunderbird One and Miss Pelear obtained a fair start.
Rule 632 states:
If, in the opinion of the Judicial Committee, a horse which does not finish in the first three placings was prevented from taking an effective part in a race owing to the mechanical failure of starting stalls, or is denied a fair start and such occurrence materially prejudiced the chances of that horse (but not where the horse is slow away by its own accord) the Judicial Committee may declare such a horse to be a non-starter.

Mr Neal showed video replays of the start and said that prior to the start Thunderbird One (L Innes) had been held by an assistant, and just prior to the start being made the horse had been let go. The horse then dived at the front gate and when the start was made the front gates on both Thunderbird One and Miss Pelear (N Harris) who drew alongside each other in gates 4 and 5 did not open in unison with all other gates. Mr Neal added that as a consequence of the gates not opening with all other gates Thunderbird One became unbalanced and shortly after leaving its stall Jockey L Innes was dislodged and that Miss Pelear was slow to begin and lost significant ground. Mr Neal said as a consequence of the gates being slow to open that the chances of both horses were materially prejudiced.
Mr G Phillips the starter said that he asked an attendant to assist in keeping Thunderbird One settled in its starting stall as it can become restless. He said that shortly prior to dispatching the field the attendant who had been holding the horse let it go and it immediately dived at the front gate. Mr Phillips believed that this locked both gates (4 & 5) and was the reason for them not opening in unison. Mr Phillips added that gates 4 and 5 are linked, hence the reason for both gates locking.
The connections of both horses did not have anything new to add.
