As Mr Perrett had admitted the breach the charge was found to be proved.

Facts:
Following the running of R2, (SMOKEY LEMON HWT) Information No. A4588 was filed with the Judicial Committee. It was alleged that Mr Perrett used his whip excessively on SIR GONZALES prior to the 200m.
Mr Perrett said that he understood the charge and confirmed that he admitted the breach.
Rule 638(3)(b)(ii) provides:
A rider shall not: (b) strike a horse with a whip in a manner or to an extent which is:
(ii)or excessive
Stipendiary Steward Mr Goodwin identified SIR GONZALES and Mr Perrett on the films and said that on the turn into the straight Mr Perrett commenced to hit his horse with the whip, and continued to do so up until the 200m without any reasonable break. He said that the horse had been struck approximately 11 times.
Mr Perrett, for his part, said that he had only hit the horse every second stride as he alternated by showing the horse the whip.
Submissions for Penalty:
Mr Jones said that Mr Perrett had a clear record over the past 12 months and asked the committee to also take into account that the breach was admitted. He said that the JCA starting point was a fine of $500 or a 2 day suspension, but added that there were mitigating factors that the committee could take into consideration. He placed the breach in the mid-range category.
Mr Perrett initially said that he preferred a suspension as opposed to a fine.
Following some discussion with Mr Perrett as to the options available to the committee, Mr Perrett responded by saying that he would like the committee to consider imposing a fine and a suspension. He advised that his next day of riding would be at Wanganui on 16 June.

The aggravating factor was that whilst Mr Perrett may have only hit his horse every second stride, he made no attempt to go back to the reins and ride within the whip guidelines. The committee placed the breach at no less than mid-range.
The mitigating factors to consider were the admittance of the breach and Mr Perrett’s clear record during the past 12 months. The committee was also mindful that jumping jockeys have a limited season in which to ply their trade.
Following careful consideration as to penalty, it was determined that a fine and a suspension would be imposed.
