Facts:
Mr Davidson alleged that Mr Johnson permitted his mount IVO JIMA to shift inwards passing the 900 metres in race 1, the REFINED RIG MAIDEN 1600, when not sufficiently clear of DAD’S BROTHER (Mr Mudhoo), which was checked and heavily restrained.
Mr McLaughlin, Stipendiary Steward, demonstrated on the video that Mr Johnson was 3 wide outside Mr Mudhoo. Mr Johnson was only a bare length clear when he looked and kept shifting across. He said Mr Mudhoo had checked his mount and there was no contact. Mr Mudhoo had had to take a firm hold but his horse had over-reacted. He demonstrated that the head of DAD’S BROTHER was pointed towards the rail at this time.
Mr Davidson said Mr Johnson had cut Mr Mudhoo’s horse short. DAD’S BROTHER had then been crowded by other horses racing to its outside who appeared to have been following Mr Johnson across. He said it was clear DAD’S BROTHER had over-reacted.
Mr Johnson said he had admitted the breach as it was clear on viewing the film that he had cut Mr Mudhoo a bit short. He stressed it was right on the point of the bend and that IVO JIMA was having its first start in blinkers He believed the horse had eased when coming across. He agreed with the Committee that he had looked a number of times. He had thought he was clear. He believed his horse had sighted the rail, eased when it got to the front, and changed leg.
Submissions for Penalty:
Mr Davidson produced the respondent’s record which evidenced three suspensions in the past year, one in December 2017 at Otaki, another in August 2018 at Riccarton, and the most recent at Hawkes Bay on 6 October. The suspensions on those days were 6, 7 and 8 days, respectively.
Mr Davidson said Mr Johnson was a leading national rider and, in that context, this could be described as not a bad record. He believed the breach was low-range. It had looked worse than it actually was, as there were contributing factors.
Mr Johnson asked for a deferment until after Saturday’s racing. He also questioned whether the Committee would consider a combined penalty of a fine and a suspension.

The Committee believes the breach can be considered to be low-range. Mr Johnson has cut Mr Mudhoo’s horse short which has then over-reacted and been crowded by two other horses.
The starting point is 6 national days. Mr Johnson’s record is good when the breaches are viewed in the light of the regularity with which he rides. One breach is not far off a year ago, although the latest is recent and more concerning. One day’s credit is appropriate for admission of the breach and record. We do not believe a combined penalty is appropriate in the circumstances. The breach can be adequately met by a suspension.
