As Ms Hemi admitted the breach we found the charge proved.
Penalty:
Ms Hemi rides predominantly in the Central Districts however the Committee was satisfied, after hearing from both Ms Hemi and the Stewards, that she has recently extended that to Northern meetings and these should be included in any suspension. We questioned Ms Hemi in particular about having Ellerslie included and she said that her agent had intended sending her North for that meeting on Sunday December 13th.
Accordingly Ms Hemi is suspended from the close of racing on Saturday December 12th up to and including racing on Saturday December 19th.

Facts:
Following the running of Race 7, Hutt News Premier 1400m, an Information was lodged by Mr R Neal stating L Hemi permitted her mount FAZED to shift outwards when not sufficiently clear of PALACE ROCK which was checked near the 300m.
Rule 638(1) (d) provides: A Rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.
Ms Hemi confirmed she admitted the breach and that she understood the charge. Due to Ms Hemi’s apprentice status Mr Smith was present to assist her.
Mr Oatham used the head-on video to identify all the runners concerned. Ms Hemi was racing in a position towards the middle of the track with PALACE ROCK (Mr Bosson) to her immediate outside and outside of Mr Bosson was MORENA (D Bothamly). The film, paused at this stage, showed PALACE ROCK with a clear run. Soon after, Ms Hemi rolled out with the consequences being that Mr Bosson lost the run he was entitled to. As a result of the interference he was checked and held up for some distance. Mr Oatham conceded that MORENA laid in as well, contributing to the incident to some degree, however the shift from Ms Hemi was the most significant one.
Rear-view and side-on films were also shown to confirm that Ms Hemi was only a bare length in front of PALACE ROCK when she moved outwards.
Neither Ms Hemi nor Mr Smith had any comments to make at this stage.
Submissions for Penalty:
Mr Neal presented Ms Hemi’s riding record for the previous 12 months which showed only one previous suspension (3 days) for careless riding in October this year.
Mr Neal submitted that the incident could be classified as midrange. He said Ms Hemi’s record is a good one with her very rarely troubling the Stewards. Mr Neal further submitted that Ms Hemi rides throughout the Central Districts and at many meetings in the Northern region.
Mr Smith said Ms Hemi averages 7-8 rides per meeting and her record is very good. There was some discussion between Mr Smith and Ms Hemi as to where she rides. Mr Smith said she does not ride down south but Ms Hemi advised she had recently been riding in the Northern area, specifically Rotorua, Tauranga, Waikato and Matamata.
She advised of riding engagements through until Saturday December 12th.
Reasons for Penalty:
In coming to a decision on penalty the committee took into account all of the submissions. We adopted, as a starting point, a five day suspension as outlined in the Penalty Guide for Judicial Committees. We assessed the degree of carelessness as midrange. The interference suffered by PALACE ROCK was significant with Mr Bosson held up for a run at a crucial stage of the race before recovering to run second. We note however that Ms Hemi’s outward shift was not large and the contributing movement inwards from MORENA exacerbated the incident. We did not believe that an uplift in penalty was warranted.
We gave credit for Ms Hemi’s admission of the breach and her very good record, imposing a suspension of four days.
