As Mr Gibbs-Mannsen admitted the breach the Committee found the charge proved.

Penalty:

The Committee granted Mr Gibbs-Mannsen a deferment to his suspension pursuant to Rule 1106(2).

Accordingly, his Licence to ride in races is suspended for a period of 2 Jumps/Highweight riding days commencing after racing on 4 June 2021 and concluding after racing on 10 June 2021. In addition, we impose a $250 fine.

Facts:

This charge arises from the running of race 1, A Benchmark 65 & Jmp Highweight event over 1600m. Stipendiary Steward, Mr Coles filed an Information pursuant to Rule 638(1)(d) alleging the Rider of RENEGADE FIGHTER (M Gibbs-Manssen), ”allowed his mount to shift in near the 300m when insufficiently clear of PATSY’S LASS which was crowded and checked”.

Mr Gibbs-Manssen acknowledged he understood the Rule and confirmed his admission of the breach.

Rule 638(1) (d) provides: A Rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.

Using the available race films Stipendiary Steward, Mr Dooley demonstrated the incident and identified the horses and riders concerned; RENEGADE FIGHTER (M Gibbs-Mannsen) and PATSY’S LAD (R Cole).

Mr Dooley said that after entering the straight Mr Gibbs-Mannsen commences to ride his horse forward, and while doing so shifts inwards crowding and checking PATSY’S LAD who was to his inside. He said that at the time of the interference, Mr Gibbs-Mannsen was only a bare length clear of PATSY’S LAD.

Mr Gibbs-Mannsen said that this was the first time he has used his stick in his left hand (and this may have contributed) but did concede he could have straightened a bit more.

Submissions for Penalty:

Mr Coles produced Mr Gibbs-Mannsen riding record which indicated no previous breaches under this Rule.

Mr Coles said Stewards assessed the level of carelessness to be in the low to mid range and said Mr Gibbs-Mannsen was never clear. He submitted the Stewards would be asking for a term of suspension.

Mr Gibbs-Mannsen had nothing to add in relation to penalty submissions and sought a deferment to any proposed suspension until after racing on 4 June 2021, as he had commitments at Riccarton.

Reasons for Penalty:

After considering the submissions and reviewing the Race film the Committee determined Mr Gibbs-Mannsen carelessness to be in the low range.

The starting point for a low range carelessness charge is a 4 day suspension and a $250 fine. The Committee accepts that due to reduced opportunities Jumps and Highweight Riders generally receive a discount on the careless riding starting points.

After viewing the film, considering all submissions, including level of carelessness and Mr Gibbs-Mannsen’s record, the Committee determined that an appropriate penalty would be a 2 day suspension and a $250 fine.
