As Mr Jago admitted the breach, we find the charge proved.

Penalty:

Accordingly, we impose a suspension on Mr Jago which will commence after racing on 2nd January 2012, and conclude after racing on 6th January 2012 (4 days).

Charge:

Following race 8, an information was filed pursuant to Rule 638(1) (d). The informant, Mr Oatham, alleged that Mr Jago allowed his mount, SING IN THE SUN, to shift in, crowding WALK THE TIGER (J Waddell), and SIENNA (T Thornton), inside the final 100 metres.

Facts:

Mr Coles demonstrated the incident using the head on and side on films. He pointed out to the committee, that Mr Jago continues to ride forward in the final 100 metres when his mount was running in. This resulted in 2 runners on his inner been crowded, and he said that Mr Jago had moved in 4 horse widths.

Mr Jago, in admitting the breach, said that he changed the stick over, but conceded it was a stride too late.

Submissions for Penalty:

Mr Oatham produced Mr Jago’s record, which showed he had a clear record in the last 12 months. He submitted the level of carelessness was low range, he said that Mr Jago had an excellent record and submitted a suspension at the bottom end would be appropriate.

Mr Jago told the committee that he had no firm commitments and would like the suspension to start immediately. He confirmed to the committee that he rides in the North Island.

Reasons for Penalty:

The committee carefully considered all the evidence and submissions as presented. The mitigating factors are Mr Jago’s excellent record, the level of carelessness which we assess as low range and his admission of the breach. However, this has to be balanced against the fact that Mr Jago was not the required distance clear when shifting ground.
