The protest is upheld and IDEAL BELLE is disqualified from the race.

The amended placings are now

Second - (6) BETTOR SPIRITS

Third - (4) STRIKE THE GOLD

Fourth - (1) BONNIE'S KHALEESI

It is ordered that dividends and stakes be paid in accordance with the amended placings.

Facts:

Following the running of the AUCKLAND CUP DEC 31 NOMS CLOSE 25 NOV HCP PACE, an Information instigating a protest was lodged by Stipendiary Steward, Mr S Mulcay against the 5th placing of IDEAL BELLE on the grounds that it broke and galloped in excess of 50 metres inside the last 200 metres of the race and was therefore in breach of the Breaking Horses Regulations.

Mr B Purdon the Trainer/Driver of IDEAL BELLE endorsed the Information with the words " I do not contest the Protest" . Mr Purdon did not wish to be present at the Hearing.

Rule 870(3) provides that any horse which breaks from its gait during a race shall promptly return to its correct gait. The Breaking Horses Regulations provide that any horse which breaks from its gait and gallops in excess of 50 metres in the last 200 metres of a race shall be in breach of Rule 870(3) and may be disqualified from the race.

Mr Mulcay demonstrated the incident by use of the race films and showed where IDEAL BELLE broke on the home turn and continued in a gallop for approximately 100 metres.
