We declare The Gallant Girl to be a non-starter.

Facts:

Mr Davidson, Stipendiary Steward, sought a ruling pursuant to Rule 632 as to whether The Gallant Girl was denied a fair start in Race 3, the Duncan Anderson Dental Rating 75 1400.

Rule 632 states:

“If, in the opinion of the Judicial Committee, a horse which does not finish in the first three placings was prevented from taking an effective part in a race owing to the mechanical failure of starting stalls, or is denied a fair start and such occurrence materially prejudiced the chances of that horse (but not where the horse is slow away by its own accord), the Judicial Committee may declare such horse to be a non-starter”.

Submissions for Decision:

Mr Davidson demonstrated on video that when the barrier gates opened The Gallant Girl, which was in barrier 4, was hampered in its start by the inside gate of the barrier not opening. Mr Davidson emphasized that The Gallant Girl is a front running or on the pace runner and otherwise a good beginner.

Ms Collett confirmed that the starter’s assistant had held the horse’s bridle in the stalls and let go of the bridle at the right time only for the inside arm of the gate not to open causing The Gallant Girl to go down on its nose and to then lurch of out of the stalls when the gate eventually opened or was forced open by the horse’s weight. This caused The Gallant Girl to immediately lose a number of lengths, possibly as much as six lengths on the field. Ms Collett emphasised that this was a fast horse out of the gates usually and invariably its racing style was to race at the front. It lost all chance at the start.

Reasons for Decision:

It is quite clear from the video footage that the inside arm of the barrier gate did not open and that The Gallant Girl was significantly hampered as a result. As a consequence when the horse jumped, upon the arm eventually moving, it was at least four or five lengths behind the rest of the field.

We are satisfied that The Gallant Girl was denied a fair start through no fault on the part of the horse and that its chances were materially affected.

We record for the record that the horse’s co-trainer Mr Dennis appeared part way through the hearing and concurred with what both Mr Davidson and Ms Collett had said.
