Facts:
Following the running of Race 9 (Life Members Mobile Pace 1750), Information Number A4206 was filed with the Judicial Committee. The Information read that third placed ATOMIC JET (M McKendry) caused interference to ninth placed HANOVER COURAGE (D Ferguson) with 150m to run.
All present acknowledged that they understood the rule.

Rule 869(8) reads:
The Judicial Committee may in addition to any other penalty which may be imposed pursuant to Rule 1003 thereof place any horse: (b) May have interfered with, or whose horseman may have interfered with, the progress or chance of any other horse or horses, - immediately after any horse from which it may have gained an advantage or whose chances or progress may have been affected thereby.

Mr Muirhead showed all films and said that HANOVER COURAGE had come from behind ATOMIC JET, was finishing strongly, was about to attempt to improve inside ATOMIC JET when that horse shifted in sharply causing Mr Ferguson to check HANOVER COURAGE, which resulted in it going off-stride, galloping and losing all chance.
Mr D Ferguson said that although his horse was interfered with he wasn’t sure if its chances had been affected. However on reflection and questioning from Mr Muirhead, Mr Ferguson said that his horse’s chances were affected as it was finishing well at the time the interference occurred.
Mr McKendry the driver of ATOMIC JET said that when he hit his horse it ducked in and wanted to continue to run about. He said that he did attempt to keep it straight but that it continued to shift about off-line. He said that it raced very greenly. He added that he didn’t believe his horse had interfered with HANOVER COURAGE as it had only followed his horse across.
Reasons for Decision:
The committee found that with approximately 150m to travel, HANOVER COURAGE was finishing very strongly and was about to attempt a run on the inside of ATOMIC JET when that horse shifted inwards abruptly. As a consequence of the shift HANOVER COURAGE was relatively severely checked, became unbalanced, broke and lost all chance. The committee was satisfied that ATOMIC JET was in breach of Rule 869(8).
