Stewards charged Mr K Chowdhoory with excessive use of the whip following Race 7. The Stewards alleged Mr Chowdhoory was in breach of r638 (3) (b) (ii) prior to the 100 metres mark. Mr Chowdhoory appeared at the hearing assisted by Mr Pitman.
Ms Haley, with the use of the videos, pointed out the position of EASYRIDER as the field entered the home straight. Mr Davidson stated Mr Chowdhoory was challenging for the lead and was seen to use his whip eight times from the top of the straight to just prior to the 100 metres mark. They were not punishing strikes with the whip, but too many.
Mr Chowdhoory stated he was caught out by the long straight. He said he was in a position to win and got too excited. He had misjudged the distance and the number of strikes. Mr Pitman accepted the evidence as given.
