Decision:

Ms Wynne admitted the charge and the charge is upheld. 

Penalty:

Ms Wynne is fined $750 and reminded of her obligations as to weighing out under the Rules of Thoroughbred Racing. 

Charge:

Rule 610 (4) reads: A Rider may not wear or have in their possession a body protector or a skull cap that has been modified in any way.

Facts:

Following the running of Race 9, the Gordon Handy Machinery Ltd R65 Benchmark, an information was filed alleging a breach of rule 610 (4) in that Ms S Wynne had in her possession a modified body protector.

Miss Wynne admitted the breach of the rule and was assisted in the hearing by Ms Middlewood.

Submissions for Decision:

Mr McLaughlin stated he noticed that Ms Wynne was having difficulty weighing out for race nine. On inspection he found Ms Wynne had an illegal body protector. He asked her to take it off. She then returned with a different body protector to weigh out but on further inspection he found the second body protector was not an approved body protector in this jurisdiction.

Ms Wynne stated she had panicked when asked to change the vest the first time. She accepted the fault was hers and was aware the body protector was not approved. She had borrowed it because hers had a broken zip. 

Submissions for Penalty:

Mr Davidson said Ms Wynne admitted to the Stewards she was having weight problems. However, there was clear intent to weigh out light. Ms Wynne was a promising apprentice jockey with plenty of ability. Ms Wynne had three minor breaches under the weight rule, but no previous charge under this rule. He sought a fine of between $500 to $600.

Ms Middlewood said Ms Wynne was very committed to the industry and was hard working. She rode track work every day and was trying hard to keep on top of her weight. Ms Wynne said she was due to return to Ireland shortly and would prefer a fine as opposed to a suspension. She was currently apprenticed to Mr N Coulbeck. 

Reasons for Penalty:

The committee's considered the evidence and penalty submissions and believe a fine is appropriate. Credit was given to Ms Wynne for her early admission of the breach and her clear remorse for her actions. However, the committee also takes into account that Ms Wynne attempted to weigh out incorrectly, and, when challenged by the Stewards gave misleading information during their inquiries. The committee believes the penalty will reflect that transgression.
