Decision:

After hearing all the evidence and viewing the films the Committee was satisfied that BANNOCKBURN was slow away of its own accord therefore we ruled that the horse be declared a starter.

Facts:

Following the running of Race 4, the Cheltenham with Wheels Handicap, the Stewards requested a ruling in relation to Rule 632 - did BANNOCKBURN receive a fair start.

Rule 632 reads: If, in the opinion of the Judicial Committee, a horse which does not finish in the first three placings was prevented from taking an effective part in a Race owing to mechanical failure of starting stalls, or is denied a fair start and such occurrence materially prejudiced the chances of that horse (but not where the horse is slow away by its own accord), the Judicial Committee may declare such horse to be a non-starter.

Submissions for Decision:

Race 4 was run over 1200m and BANNOCKBURN began from barrier number 10. Mr Goodwin showed the head-on view of the start of the race which showed BANNOCKBURN rearing up as the gates opened and an assistant holding on to the head of the horse. The Stewards’ request for a ruling was to ascertain whether or not the assistant held the horse for too long thereby denying that runner a fair start.

Evidence was heard from Ms Hemi, the rider of BANNOCKBURN who said, in her opinion, the actions of the assistant holding her horse did not affect the start. She said the horse itself affected its chances. He was beginning to “have a small tantrum” and the assistant went up to help. Ms Latta agreed saying that BANNOCKBURN could be a little difficult to handle and had caused problems at the start before. She did not believe the assistant had anything to do with the poor start today.

For the Stewards Mr Goodwin said that it appeared BANNOCKBURN did receive a fair start. The assistant was trying to help the rider by taking hold of BANNOCKBURN as it reared up and his actions did not contribute to the horse being slow away.

Reasons for Decision:

The Judicial Committee carefully considered all of the submissions.

The head-on film clarified that the gates of each stall opened in unison therefore there was no mechanical failure of the starting stalls.

Evidence from the rider of BANNOCKBURN indicated that the horse was being fractious prior to the start and the actions of the starter’s assistant were not to blame for the horse rearing as the gates opened.

Ms Latta concurred with Ms Hemi and said BANNOCKBURN had been problematic in the gates prior to today.
