Facts:
Following race 5 the informant Mr J Oatham alleged that Miss Spratt used the whip excessively on her mount WHITBY.
Submissions for Decision:
Mr Williamson demonstrated the video films which showed WHITBY ridden by Miss Spratt racing on the outside of the field soon after entering the home straight. From this point Mr Williamson showed Miss Spratt striking her horse approximately 13 times before the 200 metres without giving the required respite under the guidelines.
Miss Spratt in admitting the breach said it was just a matter of her getting the feel of the winter tracks when more whip is necessary. She assured the committee she would be more careful in the future.
Submissions for Penalty:
Mr Oatham said this was Miss Spratt's 3rd whip charge in the last 12 months. He said it was imperative that she excercise more care under this rule.
Miss Spratt had nothing to say regarding penalty.
Reasons for Penalty:
The committee considered all the evidence and submissions as presented. The only mitigating factor is Miss Spratt's admission of the breach. However the committee voiced its concern to Miss Spratt that this was her 3rd whip charge in the last 12 months. Consideration of animal welfare is of paramount importance to the general public.
