As Mr Azman has admitted the breach we find the charge proved.

Penalty:

Accordingly Mr Azman's license to ride in races is suspended from after racing at Avondale on 4 November until after racing at Hastings on 8 November, 3 days.

The race meetings involved are :

Rotorua                   6 November

Te Rapa                   7 November

Hastings                  8 November

Facts:

Following the running of race 5, the GARTSHORE CONSTRUCTION 1600, an Information was lodged by Mr Oatham alleging that Apprentice Rider Mr Z.N. Azman allowed his mount ZAFRENZY to shift in near the 50 metres when not clear of OHOPE PRINCE which had to be checked.

Mr Azman was present at the hearing and acknowledged that he admitted the breach. Apprentice Rider Mentor Mr N Harris was also present to assist Mr Azman and advised the Committee that Mr Azman's employer, Mr Manning, had seen the film of the race and was happy for Mr Harris to assist his apprentice.

Rule 638(1)(d) provides that: 'A Rider shall not ride a horse in a manner which the Judicial Committee considers to be careless'.

Using the available films Mr Coles identified the riders and horses involved in this incident. He pointed out that nearing the 100 metres mark, OHOPE PRINCE, ridden by Ms A Collett was ahead of ZAFRENZY, ridden by Mr Azman. OHOPE PRINCE was near the running rail and it was clear from the films that it was weakening out of the finish. Coming from behind that horse, ZAFRENZY improved its position and appeared to get on the heels of MAXIMUM HEIGHT outside OHOPE PRINCE. Mr Azman then angled ZAFRENZY back towards the running rail. However he was clearly not the required distance clear of OHOPE PRINCE in doing so, and this caused a sharp check to that horse. It was clear on the film that Ms Collett had to take a firm hold of her mount due to the check it received.

On behalf of Mr Azman, Mr Harris explained that he was a new apprentice who had only had his license a few months. He said that Mr Azman had to learn to keep his horses straight during races, and added that it was clear that OHOPE PRINCE was weakening when Mr Azman attempted to improve around it.

Mr Azman added that he had not expected his horse to move in as quickly as it did when he angled it back towards the running rail.

Submissions for Penalty:

Mr Oatham told the Committee that Mr Azman was a relatively new apprentice who had ridden in 78 races prior to today's meeting where he had a further 6 riding engagements. During that time he had ridden 5 winners and had not been before the JCA prior to today. Mr Oatham added that the Stewards felt today's incident was due to inexperience and some impatience. He stated that he felt the incident was at the bottom end of the scale on the level of seriousness and that any penalty could reflect that.

Mr Oatham also told the Committee that Mr Azman had recently ridden at New Plymouth and Hastings on mid-week racedays.

Mr Azman told the Committee that he had engagements for mounts at Ellerslie and Avondale in the following week, and that any suspension could commence after then.

Reasons for Penalty:

The Committee took into account all of the submissions relating to penalty. We accept that this incident was at the very low end of the scale, however we take note that any careless riding in races can have serious consequences.

The JCA Penalty Guide has a starting point of a 5 day suspension for a charge of careless riding. This may be adjusted either way given the prevailing circumstances.

We take into account Mr Azman's relative inexperience, his admission of this breach, and his good record to date. We accepted that he shows promise as a rider and want to encourage him in that regard, however there still needs to be a meaningful penalty imposed for this breach.

Taking all of the above into consideration we believe that a suspension of 3 riding days is an appropriate penalty.
