The protest is dismissed and the Judge's placing’s shall stand.

The Committee authorised the payment of stakes and dividends in accordance with its decision.

Facts:

Following the running of race 5, Barfoot & Thompson Twilight Cup, an Information was filed Instigating a Protest pursuant to Rule 642(1). The Informant, Mr G Rogerson, alleged that CAPRIKOSA or its rider placed 1st by the Judge interfered with the chances of STACCATO placed 2nd by the Judge.

The interference is alleged to have occurred in the final straight.

The Judge's placing are as follows:

1st No. 15 CAPRIKOSA
2nd No. 2 STACCATO
3rd No. 18 SPECIAL MEMORIES
4th No. 11 PALACE ROCK

The official margin between 1st and 2nd is a long head.

Rule 642(1) states: “If a placed horse or its rider causes interference within the meaning of this rule 642 to another placed horse, and the Judicial Committee is of the opinion that the horse so interfered with would have finished ahead of the first mentioned horse had such interference not occurred, they may place the first mentioned horse immediately after the horse interfered with”.

Submissions for Decision:

Mr Rogerson identified the horses involved in the alleged incident using the head – on and side - on video films. He pointed out that near the 300 metres there is a run available for STACCATO in between ALAMER and CAPRIKOSA. He believed shortly after that point Mr Du Plessis allowed CAPRIKOSA to shift in when not the required distance clear of STACCATO. He said this resulted in STACCATO being stopped in his tracks and he estimated the incident cost STACCATO between 1 to 1 and ½ lengths. Mr Rogerson noted the margin between the 2 horses at the finish is a long head.

Mr Elliot said that he was going to take the gap between ALAMER and CAPRIKOSA near the 300 metres until Mr Du Plessis shifted in ½ a length. He said this resulted in him having to check STACCATO for 2 strides and come out across CAPRIKOSA’s heels for a run. Mr Elliot also noted the margin between the 2 horses at the finish.

Mr Du Plessis identified on the films that in the final straight STACCATO is not travelling comfortably and the horse is racing erratic in behind CAPRIKOSA. He pointed out on the head – on film that CAPRIKOSA did not move at all and his mount stayed on the same running line. Mr Du Plessis demonstrated that ALAMER is the horse that caused the interference to STACCATO when it shifts outwards approaching the 300 metres. He said this is the reason why Mr Elliot ended up on CAPRIKOSA’s heels and emphasised it was through no fault of his mount.

Mr Williams identified that STACCATO is never comfortable in the running and he said that CAPRIKOSA never moved in near the 300 metres. He maintained that CAPRIKOSA went straight all the way to the finish line.

Mr Coles on behalf of the Stewards submitted that early in the home straight there is slight inward movement by CAPRIKOSA. However, he identified on the head – on that there is a run available for STACCATO approaching the 300 metres until ALAMER shifts out and takes its rightful line of running.

Reasons for Decision:

The Committee carefully considered all of the submissions presented and reviewed the video footage several times. We established at the 400 metres CAPRIKOSA is racing in 3rd position with STACCATO following her in 5th position. Approaching the 300 metres the head – on film clearly shows that a gap is presented for STACCATO between ALAMER and CAPRIKOSA. Mr Elliot is riding STACCATO forward with the whip when the gap closes. This is when ALAMER shifts out into STACCATO’s rightful running line. This resulted in STACCATO being briefly held up when becoming awkwardly placed on the heels of CAPRIKOSA. Mr Elliot then had to angle his mount across that runner’s heels to gain a clear run and we observed the horse finished the race off strongly.

The Committee when deliberating took the opportunity to analysis the back – on film of the incident. This confirmed that ALAMER is the horse that caused the interference to STACCATO near the 300 metres and not CAPRIKOSA. It is evident that when Mr Elliot is checking his mount CAPRIKOSA is maintaining a straight line and it is ALAMER which has shifted out.

After taking into account all of the above in our opinion there are insufficient grounds to justify a change of placings.
