Facts:
Following the running of race 8 the COPPER CAFÉ & BAR/WHITE ROBE LODGE CLARE MEMORIAL GOLD CUP OPEN HDCP, Mr Cropp, representing the connections of ALPINE HEIGHTS lodged a protest against the second placed horse KING PRAWN (KC Walters) alleging interference about 100 metres from the finish.
Rule 642(1) provides:
If a placed horse or its Rider causes interference within the meaning of this Rule 642 to another placed horse, and the Judicial Committee is of the opinion that the horse so interfered with would have finished ahead of the first mentioned horse had such interference not occurred, they may place the first mentioned horse immediately after the horse interfered with.

Mr Cropp stated ALPINE HEIGHTS was travelling well on the home bend. He said he moved his mount forward when straightening up and was improving quickly. He improved his position to be up on the flank of KING PRAWN when KING PRAWN rolled outwards. He yelled out to Mr Walters who immediately corrected and straightened his mount. However, he said he was forced to check his mount, losing momentum and at least three quarters of a length. He was adamant the check cost him second placing.
Mr Walters stated his mount rolled out under pressure. When Mr Cropp yelled out to him he had corrected his mount immediately. He believed they were too close to the finish line for ALPINE HEIGHTS to make up the ground of half a length to the finish. He was always confident he would run second.
Mr Phillips stated both mounts were being ridden hard. He believed they were too close to the line for ALPINE HEIGHTS to make up half a length over the final 100 metres.
Mr Davidson stated ALPINE HEIGHTS was entitled to be where he was and to take the gap. Mr Cropp had to check his mount and in doing so ALPINE HEIGHTS lost momentum. The horse had lost three quarters of a length as a result of the interference.
Reasons for Decision:
The Committee was satisfied the interference to ALPINE HEIGHTS cost the horse at least three quarters of a length. The horse had rallied over the final 100 metres after losing momentum as a result of the check and was a half length from KING PRAWN at the finish. We are of the opinion that ALPINE HEIGHTS would have beaten KING PRAWN if interference had not occurred.
