Facts:

At the conclusion of Race 8, the SOUTHERN WINES JUNIOR DRIVERS TROT, an information was lodged by Mr Wallis under r 870(3) and (5) alleging VITALI broke in excess of 50 metres over the final 200 metres and was also in a break over the finishing line when lapped on by MALDARNA.

Judge’s placings were:

2ND 2 VERY PERSUASIVE
3RD 11 FOREVERMAN
4TH 10 VITALI
5TH 1 MALDARNA

Submissions for Decision:

Mr J Versteeg, the trainer of VITALI, indicated on the information that he represented the connections of that horse and did not contest the protest.

Mr Wallis demonstrated that VITALI, when mounting a run down the centre of the track, galloped just outside the final 100 metres and continued in a break to the winning post. VITALI was lapped on by MALDARNA.

Reasons for Decision:

VITALI galloped with some 110 metres to race. The horse, which had not suffered interference from any other runner, continued across the line in a gallop. The horse was also lapped on by MALDARNA.

In these circumstances the Committee is satisfied that VITALI has failed to promptly regain its gait. The Committee exercises its discretion, and VITALI is disqualified pursuant to r 1003(2)(a). There is no need to make a ruling under the “lapped on” Rule.
