Facts:
Following the running of Race 8 the SOUTH FUELS KEEPING PRIMARY INDUSTRYS MOVING MOBILE PACE, an information was filed by Stipendiary Steward, Mr S Renault, against Licensed Driver D Keast, alleging that, "Driver D Keast drove carelessly near the 100 metres when striking the wheel of PAT CAMPBELL (J Young)."
Mr Keast had signed the information admitting the breach and that he did not wish to be present at the hearing of this information.
Rule 869 provides as follows:
(2) No horseman in any race shall drive: -
(b) carelessly
Mr Renault, using two angles of the race films, identified Mr Keast driving AVEROSS RUSTLER 3 wide and 1 back and PAT CAMPBELL in the parked position. With approximately 150 metres to run Mr Renault pointed to Mr Keast angling across the back of PAT CAMPBELL and slowed the video to show AVEROSS RUSTLER strike the outside wheel of PAT CAMPBELL puncturing the tyre. Mr Renault estimated PAT CAMPBELL had dragged the punctured wheel for the last 100 metres, finishing 6th within a short margin of Mr Keast who ran 4th.

Mr Renault said Mr Keast has had 66 drives this season and has a clear record under this rule. He alluded to the JCA starting point for a breach of this rule being a $300 fine He considered Mr Keast deserves some credit for his good record and his status as a junior driver.
Reasons for Penalty:
In determining penalty, the Committee has adopted the starting point of a $300 fine as per the penalty guide. There were no aggravating factors to consider. In mitigation we indorsed a discount for Mr Keast’s good record, the admittance of the breach and his Junior Driver status.
