Meet Title:

Meet Chair:

Meet Committee Member 1:
DJohnstone

Race Date:
2010/11/05

Race Number:
R1

Decision:

As the breach was admitted we find the charge proved.

Penalty:

Miss. Myers, you are suspended from race riding after the completion of racing on Thursday the 11th November until the completion of racing on Thursday the 18th of November – 4 national racing days.

Charge:

Careless Riding

Facts:

Miss. R. Myers the rider of Darby Shaw in Race 1 admitted a charge of careless riding in that she allowed her mount to shift in passing the 1400 metre mark when not clear of Steel (S. Collett) which was checked.

Rule 638 (1) (d) reads: “A rider shall not ride a horse in a manner which the Judicial Committee considers to be careless”.

Miss. Myers was represented by licensed trainer Mr. P. Campbell.

Mr. N. Goodwin showed the available films and indicated the point at which Miss. Myers angled her mount inwards when not clear causing heels to clip and the rider of Steel (Miss. Collett) to take hold. He believed that Steel was travelling keenly and slightly over racing at the time but after the incident Steel went back through the field.

Both Miss. Myers and Mr. Campbell concurred with Mr. Goodwins comments and had nothing further to add.

Submissions for Penalty:

Mr. Goodwin informed the committee that Miss. Myers has been found guilty under this rule four times so for this year. A 4 day suspension was imposed on the 19/11/2009 – 4 days on 07/01/2010, a 5 day suspension on 01/04/2010. He believed her record was not good. However, the stewards had over the last few months noticed a marked improvement in her riding which he believed was to Miss. Myers credit. She does take a lot of rides and can be classed as a national rider.

He felt the incident was not at the top end of the scale but should be reflected by a period of suspension at the lower end.

Miss. Myers in her submission agreed she has worked to improve her riding and that she did take a lot of rides throughout New Zealand. She had hoped to have had a possible ride in the New Zealand Cup on Saturday week at Riccarton however it was explained to her it fell outside the 7 day stand down she asked if any suspension imposed could begin after the 11th of November.

Reasons for Penalty:

In coming to our decision to impose a period of suspension we have taken account of your admittance of the breach. We concur also with Mr. Goodwin’s comments on your improved riding record over the last 6 months and the number of rides you take nationally. We are of the opinion that this incident was at the lower end of the scale but a horse was inconvenienced by your actions in crossing over when not sufficiently clear.
