Mr Kennedy admitted the breach which is found to be proven.

 

Penalty:

A fine of the sum of $150 is imposed.

Charge:

At the conclusion of race 4 information number 5552 was logged by Stipendiary Steward, Mr M Davidson under rule 614(2) alleging that Mr T Kennedy, trainer of Dubai Bear and Drumhill was careless and neglectful in saddling these two runners in race 4.
 
The rule reads a person must not be neglectful or careless in saddling a horse.

Facts:

Mr Davidson said that Mr Kennedy advised Stipendiary Stewards prior to the start of the race that two of the four horses he had entered in the event had incorrect saddlecloths. The horses Dubai Bear (3) and Drumhill (5) were brought back to the birdcage, their riders re-weighed and saddlecloths changed.

Submissions for Decision:

Mr Kennedy advised the committee that both horses had passed the plate inspection which should have picked up the error. However it was only through Mr Kennedy’s observation that two near identical horses were incorrectly numbered that the error came to the Stewards notice.

Submissions for Penalty:

Stipendiary Stewart Mr Davidson stated that there had been a recent breach of the rule set at Riccarton were a $300 fine had been imposed relating to a second offence. However, in this case given Mr Kennedy’s clear record and the fact that the error should have been picked up in the plating area a fine in the range of $150 to $250 would be appropriate, due to the strict liability associated with this breach.

Reasons for Penalty:

As Mr Kennedy has admitted the breach it is found to be proven. The Committee has taken into account Mr Kennedy has no previous breaches under this rule and also that he very quickly advised the stewards of the error in saddling the 2 horses.
