Facts:
Following the running of race 8, the TELFER ELECTRICAL HANDICAP PACE, Mr Renault lodged an information alleging that near the 1300 metres Mr Telfer shifted his horse BOOMER BAILEY outwards resulting in EAMON MAGUIRE (M Anderson) being forced wider on the track.
Rule 869(4) and (6)(b) and (c) read:
(4) No horseman shall during any race do anything which interferes or is likely to interfere with his own horse and/or any other horse and its progress.
(6)(b) a horse making a forward movement during any race shall not be forced to race wider on the track.
(6)(c) a horse during a race shall not move ground outwards once the nose of the wider runner coming forward is in line with or past its sulky wheel and until the wider runner going forward is fully past.
Mr Telfer indicated on the information that he admitted the breach and did not wish to be present at the hearing.
Mr Renault demonstrated on the videos that near the 1300 metres when Mr Anderson was progressing forward 3 wide and was alongside Mr Telfer, Mr Telfer comes out and forces him 4 wide as he is racing into the bend.

Mr Renault produced the respondent’s record. Mr Telfer is not a busy driver. He has had 2 drives this season, 28 last and 27 the season before. He has a clear record under this rule for the past 12 months.
Mr Renault stated the starting point in the JCA Penalty Guide was a $250 fine or a 5-drive suspension. He submitted a fine of $200 was appropriate.

Mr Telfer has shifted Mr Anderson wider on the track in contravention of the push out rule. As a consequence, Mr Anderson was forced to race 4 wide into the bend.
The respondent has a very good record under this rule and has admitted the breach. A starting point of $250 is appropriate and the mitigating factors warrant a $50 reduction to the sum of $200.
