As the breach was admitted the Commiteee the charge proved.

Penalty:

Accordingly, Ms Hercock’s Licence is suspended for 5 national riding days from the conclusion of racing on 5 June 2021, until the conclusion of racing on 12 June 2021.

Facts:

Following the running of Race 6, the CONCERT HALL Cup, Mr Goodwin presented an Information alleging that Jockey Ms K Hercock, Rider of STORMY HABIT “committed a breach of Rule 638(3)(b) (ii) [striking her mount excessively with the whip] prior to the 100 metres point.

Ms Hercock admitted the charge.

The Race film identified that Ms Hercock struck her mount 9 times when in the home straight and before the 100 metres point. This was nearly twice the Guideline limitation of 5 strikes.

Submissions for Penalty:

Mr Goodwin advised that in the short time back to resume racie riding Ms Hercock has committed 2 breaches of the excessive whip use Rule, having been fined $350 on 2 January 2021 and $600 on 15 April 2021.

Ms Hercock expressed significant remorse and contrition, saying she “had stuffed up” and “was trying too hard”. She said she had committed engagements in the next 7 days.

Reasons for Penalty:

We consider a suspension of 5 days (in line with the Guide for a 4th offence – even though this was a 3rd – but came within 4 months) is required. But we do not see that further sanctions by way of fine is necessary, as Mr Goodwin accepted.
