As the breach was admitted we find the charge proved.

Penalty:

After taking all the above into account, the committee has determined a 5 day suspension is appropriate.  Accordingly and under the provisions of rule 1106 (2) we suspend Mr Innes from riding in races which is to start after racing on 1 January and conclude after racing on 6 January 2012. (5 days)

Facts:

Following race 1 an information was filed pursuant to rule 638(1) (d).  The informant Mr C George alleged that near the 300 metres Mr L Innes rider of FABRIQUE allowed his mount to shift out when not clear of MR SOX (C Grylls) which was checked.  MAREKA MISS (Miss D Johnson) who was following was also checked. 

Submissions for Decision:

Mr George demonstrated the video films and pointed out to the committee, Mr Innes riding FABRIQUE, angle his mount out to take a gap near the 300 metres.  In doing so, the films clearly showed he took the line of MR SOX (C Grylls) when insufficiently clear.  This caused Mr Grylls to check which in turn caused Miss Johnson, riding MAREKA MISS to take evasive action and lose ground.  Mr George conceded that MR SOX was stopping at the time.

Mr Innes said he believed he was entitled to take the gap in front of him but his mount moved out more than he wanted.  He said Mr Grylls was only moved out a marginal amount.

Mr George submitted Mr Innes had incurred 3 charges this year.  He believed today's breach by Mr Innes was in the low to medium range.

Mr Innes said he had commitments up to and including 1 January 2012.  Upon questioning by the committee Mr Innes said he had commitments throughout the North Island in the week following. 

Reasons for Penalty:

The committee considered all submissions and evidence.  Mr Innes' admission of the breach was the only mitigating factor.  However it was very evident on the films he was not the required distance clear when moving out.  The committee finds Mr Innes' carelessness to be in the low to mid range.
