Following the running of Race 6 (Salty Dog Cafe & Bar Mobile Pace) Information No. A4205 was filed with the Judicial Committee. The Information read that horseman Mr J Abernethy used his whip excessively when driving BETA B QUICK over the concluding stages.
Rule 869(2)(a) reads:
No horseman shall during any race use his whip in an unnecessary way, excessive or improper manner.
Mr Abernethy confirmed that he admitted the breach and that he understood the rule.
Mr Muirhead showed the films and said that Mr Abernethy hit his horse 21 times in the final straight without any noticeable pauses. Mr Abernethy agreed that he had hit his horse 21 times.

Mr Muirhead said that the last time Mr Abernethy had been fined for a similar offence was in June 2013 and on that occasion he was fined $250. He added that his record in recent times was good.
Mr Abernethy said that he has had approximately 400 drives since his last penalty was imposed. He added that the relatively long straight was a contributing factor and that he did not believe that his whip use on this occasion was at the top-end.
Reasons for Penalty:
The committee took into account Mr Abernethy’s good record, the admittance of the breach and other penalties imposed for similar breaches.
