Facts:
Following the running of the STEELMAC TRADING LTD 1600 an Information was lodged by Stipendiary Steward Mr A Coles against rider Ms J Fawcett alleging that Ms Fawcett used her whip excessively when riding TEEN TITAN prior to the 100 metres.
Rule 638(3)(b)(ii) provides: A Rider shall not strike a horse with a whip in a manner or to an extent which is excessive.
Without affecting the generality of Rule 638(3)(b) a rider may be penalised if their whip use is outside of the following guidelines:
Inside the final 600 metres of a race, official trial or jump-out a horse may be struck with the drawn whip up to five times after which the rider must cease their use of the whip for a minimum of five strides before striking the horse again with the drawn whip, with this restriction to apply prior to the final 100 metres.
The whip may then be used at the rider's discretion until the winning post is reached.
Ms Fawcett was present at the Hearing and she advised the Committee that she understood the Rule and the Guidelines and that she admitted the breach. Mr N Harris was present in support of Ms Fawcett.
Stipendiary Steward Mr B Jones demonstrated the incident by use of the race films. He identified Ms Fawcett and her horse TEEN TITAN. He showed where Ms Fawcett had used her whip on her horse 9 times prior to the 100 metres mark. He said that one of the strikes was just prior to the 100 metres mark.
Ms Fawcett agreed with the number of strikes and said that she thought she saw the 100 metres mark and she wanted to win the race.
Submissions for Penalty:
Mr Coles said that Ms Fawcett has had one whip charge since the reset period and that was in December 2019. He said that in terms of the JCA Guidelines the appropriate penalty was a fine of $500.
Ms Fawcett submitted that the level of fine was too high but the Committee advised her that that figure was prescribed in the Guidelines and although JCA Committees could have discretion in other areas they could not do so as far as the whip was concerned.
Ms Fawcett was also advised that any further charge would be dealt with by a suspension.
Reasons for Penalty:
The breach is admitted and this is Ms Fawcett's second charge since the reset period and therefore the appropriate fine is $500.
