Accordingly, the Committee declared SEA MAJOR to be a non-starter and BELLAPIN was promoted from 5th to 4th place. The amended placings are now:

Facts:
Following the running of Race 7, Team Williams 1200, an Information was filed pursuant to Rule 632. The Informant, Mr J Oatham, requested a ruling from the Judicial Committee if SEA MAJOR was denied a fair start due to mechanical failure of the gates.
The Judge's placings were as follows:
1st - No.9 LA VALETA
2nd - No.1 SO WOTIF
3rd - No.11 RICH BILLIE MARSH
4th - No.10 SEA MAJOR
5th - No. 4 BELLAPIN
Rule 632 provides “If, in the opinion of the Judicial Committee, a horse which does not finish in the first three placings was prevented from taking an effective part in a race owing to the mechanical failure of starting stalls, or is denied a fair start and such occurrence materially prejudiced the chances of that horse (but not where the horse is slow away of its own accord), the Judicial Committee may declare such horse to be a non-starter.”
Both Mr Pender and Mr Sweeney acknowledged that they understood the nature of the Information and the Rule which was read aloud by Mr Oatham.
Submissions for Decision:
Mr Oatham demonstrated to the Committee on the head-on video film that SEA MAJOR’S gate failed to open in conjunction with all the other starting stalls. He demonstrated on the side-on film that SEA MAJOR left the stalls awkwardly after being impeded and believed the incident cost SEA MAJOR a conservative 3 to 4 lengths. Mr Oatham submitted the horse was denied a fair start due to a mechanical failure of the starting stalls and was of the view SEA MAJOR should be declared a non–starter.
Mr Sweeney and Mr Pender agreed with the submissions presented by Mr Oatham. However, Mr Pender expressed his concern on behalf of SEA MAJOR’S connections that the horse had earned $1,500 for finishing in 4th place. Mr Oatham advised Mr Pender that at the completion of this hearing he would discuss the matter further and provide him with some assistance regarding the incident.
Mr Sweeney and Mr Pender both acknowledged, under the Rules, the Committee were required to declare SEA MAJOR a non–starter due to the mechanical failure of her starting stall.
Reasons for Decision:
The Committee carefully considered the submissions presented and reviewed the video films. It was very clear SEA MAJOR’s starting stall was slow to open due to a mechanical failure. We are satisfied this materially prejudiced the chances of SEA MAJOR. We believe the incident cost SEA MAJOR approximately 4 lengths and we note SEA MAJOR made up ground well in the straight to be placed 4th by the Judge.
