As L Allpress has admitted the breach the committee find the charge proved. 

Penalty:

The committee have taken all the above into consideration and impose a term of suspension.

The suspension will commence after the close of racing on Friday 30 November up to and including Friday 7 December 2012 (6 days), Wanganui 1st December, Otago 2nd, Waikato 3rd, Counties 5th, Taranaki 6th, Canterbury 7th.

Charge:

Following the running of race one an information was filed by Mr Neal alleging a breach of rule 638(1) (d) in that, L Allpress permitted her mount Itsanobraina to shift out near the 200 metres when not clear causing interference to Landlord and Here’s De Consul. Mr Neal read the rule which was confirmed.

Facts:

Mr Neal moved immediately to the film showing where L Allpress has allowed her mount to shift out while under a hard ride at approximately the 200 metre mark in the run home. L Allpress was not the required distance clear of the runners on her outside and subsequently caused interference to Landlord and Here’s De Consul.

L Allpress stated she had not realised the other horses were as close as they were, and in letting her mount drift out, has then straightened her line and her mount has then come back a little on Landlord. I have not angled out and it was not intentional.

Submissions for Penalty:

Mr Neal said L Allpress had a very impressive riding record with only two suspensions in the previous calendar year, 1 September 2012 (4 days) and 27 December 2011 (6 days). From the country’s leading rider it is submitted by the stewards that is an excellent riding record. Regarding this incident there has been a relegation as a consequence of L Allpress’s riding in the home straight. The incident sits above the mid-range. The amount of movement out was not overly significant but the consequences were. Any suspension, the committee should consider that L Allpress rides throughout the country. L Allpress sought leave to consider her riding engagements. At this point the committee adjourned. 

Reconvening – L Allpress informed the committee that she sought leave to apply the 7 day rule.

Reasons for Penalty:

The committee has taken into account all the submissions and evidence presented and adopt a starting point of five days suspension. Due to the degree of carelessness which was above mid-range and the consequences of that carelessness resulted in multiple protests and a relegation. We believe that a penalty in the range of seven days suspension is warranted. The committee have taken into account mitigating factors of L Allpress’ admission of the breach and her excellent riding record under that rule.
