Following Race 8, Stipendiary Steward, Mr Goodwin lodged an Information with the Judicial Committee alleging a breach of Rule 638(3)(b)(ii) in that B May used the whip excessively prior to the 100m.
At the outset of the hearing, Mr May confirmed he understood the Rule and that he admitted the breach.
Mr Goodwin used the videos from the top of the straight to show Mr May using his whip for a total 8 times before the 100m mark. He finished 4th in the race.
Mr May was satisfied that this number of strikes was accurate.

Mr Goodwin said this was Mr May’s second breach of the whip Rule. He was fined $300 at Waikato in September 2020.
Mr May is a South African rider who has been in NZ for a number of months. He said the Rules in South Africa allow for 15 strikes over the length of a race, but he is not a rider who uses the whip a lot or unnecessarily. Today his horse was responding and gaining ground, and he simply erred in his counting on his first day riding at the Hastings track.

The Committee considered all submissions. Mr May used his whip 3 times more than allowed. He is clearly getting used to riding under different whip Rules and his explanation was not an attempt at mitigation but in response to questions from the Chair. There were no aggravating factors requiring an uplift from the starting point.
Mr May is aware that future breaches will likely result in suspension.
