Decision:

Accordingly, HE’S DONE A RUNNER was declared a non- starter.

Facts:

Following the running of Race 7(Wanganui Aquashield Roofing 1200) an information was lodged with the Judicial Committee requesting a ruling in relation to Rule 632 into the start.
Rule 632(1) reads: If, in the opinion of the Judicial Committee, a horse which does not finish in the first three placings was prevented from taking an effective part in a Race owing to mechanical failure of starting stalls, or is denied a fair start and such occurrence materially prejudiced the chances of that horse (but not where the horse is slow away by its own accord), the Judicial Committee may declare such horse to be a non-starter.

Submissions for Decision:

Mr Balcombe played the head and side on videos of the start. HE’S DONE A RUNNER started from the outside barrier. Ms Hirini, the rider of the horse, did not have her right leg in the iron when the starting gates opened. As a result, she came out “on the horse’s mouth” and had no control over it. The horse lost several lengths.
 Ms Hirini fell from the horse soon after the finish of the race and the Committee was advised she was not available to be present to give her account of the incident, but trainer Mr Breslin said it was obvious she was not ready when the gates opened.

Mr Philips explained they had difficulty getting the horse to load into the barrier, and there was an assistant with it. Immediately before letting the field go, Mr Philips called “all good?” and the assistants replied “yes”. Mr Hirini evidently called out “no”, but Mr Philips had already pressed the start button.

Reasons for Decision:

The Judicial Committee considered all submissions. The head-on film clearly showed that HE’S DONE A RUNNER reared as the gates open and subsequently veered off to the right of the track losing many lengths on the rest of the field. Mr Balcombe slowed the film right down and pointed to Ms Hirini’s right leg dangling down below the iron as the gates opened. We were satisfied that, due to miscommunication between the Starter and his assitants, HE’s DONE A RUNNER was denied a fair start. Looking at the amount of ground lost, we were also satisfied that its chances were materially prejudiced by Ms Hirini being completely unbalanced as a result of only having one foot in the irons.
