Decision:

After taking all the above into account the protest is dismissed and the Judge's placings shall stand. We order the payment of stakes and dividends accordingly.

Facts:

Following Race 3 the Higgins Coatings Tauranga '1600' a protest was lodged by the informant Mr L Innes. He alleged that WORTHING placed 2nd by the judge interfered with the chances of his mount CLARA JANE placed 4th by the judge. He said this interference occurred in the final straight.

The Judge's placings were as follows:

7 SAKHEE'S SOLDIER  1st

1 WORTHING             2nd

5 KING KROVANH      3rd

8 CLARA JANE            4th

The margins were 2 1/4 lengths between first and second, 3/4 length between second and third and 1 1/4 between third and fourth.

Submissions for Decision:

Mr Innes demonstrated on the video films where WORTHING moved out soon after entering the final straight and in doing so take his rightful line of running. He said this resulted in him being taken out 25 metres or so and believed he would have finished 2nd if this had not occurred.

Mr Alton submitted that Mr Innes only had to check for 2 strides and it made no difference to the result.

Mr Williamson said although WORTHING did come out and interfere slightly with CLARA JANE he believed it was not significant enough to effect the result.

Reasons for Decision:

The committee carefully considered all the evidence and reviewed the video films. While we concede that Mr Innes did suffer some inconvenience when WORTHING moved out taking his line, he only had to check his mount for a stride or two. From that point he still had 200 metres to make up any lost ground and the margin between 2nd and 4th at the post was 2 lengths. For these reasons we are not satisfied that CLARA JANE would have beaten WORTHING if interference had not occurred.
