As Mr Muniandy has admitted the breach, it is found proved.
Penalty:
The penalty is thus 9 national riding days’ suspension. This commences after racing on 17 December and concludes after racing on 28 December.
Facts:
Mr McLaughlin filed an Information alleging Mr Muniandy (KERANY) rode carelessly when he allowed his mount to shift outwards when not sufficiently clear of OUR GOLDEN GIRL (C Campbell) which was checked with MUSTARD and DECEPTIO VISUS being hampered passing the 700 metres in Race 1, the WINGATUI FUNCTION CENTRE 820 metres.
Mr Davidson, Stipendiary Steward, demonstrated on the video replays that shortly after the start the respondent shifted in and Mr Campbell had to check his mount off the respondent’s heels. Mr Campbell then went out and around Mr Muniandy. He said Mr Muniandy was not his length and another clear when he shifted in and Mr Campbell was “lucky” not to have clipped heels with Mr Muniandy. The other affected horses were only mildly hampered. Their jockeys only had to take hold for one stride.
Mr Muniandy said it was a 2-year-old race. KERANY had not trialled and was field shy. His horse had shifted in more than he had intended. He believed Mr Campbell had over-reacted.
Mr Muniandy said KERANY had jumped awkwardly and had “run in and out”. His intention was to go forward and to “go across quietly”. He said he was going better than Mr Campbell at this time. He said there was no calling as he was going that fast.
Mr McLaughlin disputed the respondent’s contention that his horse had run around.
We asked to view the race in its entirety and we could not see that KERANY had run in and out, as Mr Muniandy had claimed.
Submissions for Penalty:
Mr McLaughlin described the breach as high end. He submitted a 10 day starting point was appropriate. He produced the respondent’s record which evidenced a suspension on 18 November at Riccarton where the penalty was 11 days. Mr Muniandy had also been suspended in March and April this year. He described the respondent as a senior South Island rider and the record as a “neutral factor”.
Reasons for Penalty:
KERANY missed the start and was hunted forward by Mr Muniandy. He made an angled run across Mr Campbell’s mount when he was never more than ½ a length clear of him. Fortunately, Mr Campbell was able to restrain his mount and come outside KERANY. We do not agree with Mr Muniandy that he was coming across “quietly”.
We view the breach as high end and take the 10 national riding day starting point. We do not increase the starting point having regard to record and give a one day discount for admission of the breach.
