As Mr Poutama admitted the breach it was found to be proved.

Penalty:

The committee after giving consideration to the penalty submissions and being mindful of other penalties imposed for similar breaches, imposed a fine of $200.

Charge:

Allowed horse to protrude inside the marker line over the concluding stages.

Facts:

Information A2319 was filed by Stipendiary Steward Mr Muirhead under Rule 869(7)(A).

The Information stated that Mr Poutama allowed his horse “Dionysus” to protrude inside the marker line over the concluding stages.

Mr Poutama acknowledged that he understood the rule and the charge and confirmed that he admitted the breach.

Submissions for Decision:

Mr Muirhead showed both head and side-on video replays and said that in the run down the final straight Mr Poutama allowed his drive to improve up inside the leading horse when there was insufficient room to do so. He said that as a consequence Mr Poutama’s drive “Dionysus” went over and inside a number of markers. Mr Ferguson said that Mr Poutama was a little unlucky in that there was nearly sufficient room for him to improve his drive and that he was being competitive in the interests of the connections and the punters.

Submissions for Penalty:

Mr Muirhead said that the guidelines for such a breach has a $200 starting point. He said that when a horse is relegated or disqualified (as was Dionysus) that fines of up to $400 have been imposed. He added that Mr Poutama has a clear record, is a Junior Horseman, admitted the breach and submitted a fine at the lower end of the scale be imposed. Mr Ferguson for Mr Poutama said that Mr Poutama is a Junior Horseman with limited experience, that he had lost out due to his drive being disqualified and said that a minor fine would be adequate. Mr Poutama elected not to make comment.

Reasons for Penalty:

The Committee has reviewed the films of the incident and considered the submissions of all parties.  It is quite clear that Mr Poutama has touched and also moved inside the markers in the home straight for between 40 and 60 metres.  In doing so he has gained an advantage which has allowed him to finish in third place (although subsequently disqualified).

He has therefore clearly breached Rule 869 (7)(b).
