Facts:

Mr T Harris admitted a breach of rule 605 (1) in that he failed to present himself in the jockeys room by the required time.

Rule 605 (1) reads "A rider who has a ruling engagement at a race meeting must present himself in the jockeys room at lease 40 minutes before the starting time for the first race in which he has a riding engagement".

Mr. Goodwin informed the committee that Mr Harris admitted that he understood the rule and his obligations under it. He had underestimated the time it took to drive from his home to the Hastings Racecourse. Having not long returned to race riding from a lengthy period away, he should have been more vigilant.

Mr Harris confirmed Mr Goodwin's submission and had little to add.

Mr Goodwin submitted that a fine for this breach would be appropriate. He asked for a fine of between $200 - $300 and informed the committee that this was Mr. Harris’ first breach of the rule.

Mr Harris, in coming to our decision to impose a fine for this breach, we have taken into account your admittance and that this is your first charge under this rule.

Even though you have recently returned to race riding you have obligations that you must honour. Although it is New Years Day, every other jockey arrived at the course on time.

The JCA penalty guide uses the sum of $300 as a base in arriving at an appropriate penalty. We are prepared to discount that amount to reflect your admittance and fact that this is your first breach of the rule.
