As Mr Lammas admitted the breach the Committee found the charge proved.
Penalty:
The Committee granted a deferment to Mr Lammas’ suspension pursuant to Rule 1106(2).
Accordingly, Mr Lammas had his license to ride in races suspended for a period to commence after racing on 20 March and conclude after racing on 25 March 2019.
Facts:
Following the running of race 3, Trees Tavern1200, an Information was filed pursuant to Rule 638 (1)(d). The Informant, Mr Coles, alleged that Mr Lammas angled his mount MOERAKI in when not sufficiently clear of EARLY MORNING RISE which was checked near the 100 metres.
Rule 638(1) (d) provides: A Rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.
Mr Lammas said that he understood the Rule and confirmed he admitted the breach.
Mr Davidson demonstrated the incident using the available video footage. He identified that Mr Lammas angled his mount in near the 100 metres when not sufficiently clear of EARLY MORNING RISE. As a result that runner was placed in restricted room and checked.
Mr Lammas said that his mount moved in more that he had intended to. He said that he did not realise EARLY MORNING RISE was racing to his inside. He added that his mount was green.
Submissions for Penalty:
Mr Coles produced Mr Lammas’ record which showed 1 previous breach under this Rule in the last 12 months. He said this was an excellent record and described the level of carelessness as low range. He submitted a suspension in line with that would be appropriate.
Mr Lammas said that he had firm commitments up to and including 20 March and requested a 7 day deferment to his proposed suspension.
Reasons for Penalty:
The Committee considered all the evidence and submissions presented.
It was clear of the video films that Mr Lammas permitted his mount to shift in when only 1 length clear of EARLY MORNING RISE. As a consequence that runner was crowded for room and checked near the 100 metres. The Committee deemed the level of carelessness was low range.
The JCA Penalty Guide starting point for low range carelessness is 6 days which was adopted.
There were no aggravating factors.
The mitigating factors were Mr Lammas' admission of the breach and his very good record. For these collective factors Mr Lammas was afforded a 1 day reduction in penalty.
After taking into account all the above factors the Committee considered that an appropriate suspension was 5 national riding days.
