Facts:
Following the running of Race 11, the THAMES HARNESS RACING CLUB HANDICAP TROT, Mr Muirhead produced an Information instigating a protest against the 5th placing of the horse TOBRUK alleging that it had broken in excess of 150 metres rounding the first turn.
Ms M Wallis, the co-Trainer and driver of the horse noted on the Information that the Protest was not contested and that she did not wish to be present at the hearing.
Rule 870(3) provides that 'Any horse which breaks from its gait shall promptly regain its proper gait'.
The Breaking Horses Regulations (a) provide that 'Any horse which breaks from its gait either at the start or during the running of any race and continues on in the break for a distance of 150 metres or greater, shall be deemed to be in breach of Rule 870(3) in that it has failed to promptly regain its proper gait'.

Mr Muirhead identified the horse TOBRUK on the films. This race was over 2600m and started in the back straight. Shortly after the start Mr Muirhead pointed out that TOBRUK had gone offstride and then commenced to gallop for approximately 170 metres before finally reverting to a trot. The horse eventually finished in 5th place. Mr Muirhead stated that the horse had breached the Rule and Regulations applicable and asked that it be disqualified from the race.
Reasons for Decision:
It was clear from the films that the horse TOBRUK had galloped for more than 150 metres and was therefore in breach of the Rule and Regulations.
The Protest was not contested by the co-trainer/driver of the horse.
