It was ordered that dividends and stakes be paid in accordance with the amended placings.

Facts:

Following the running of the PUNKIN"A SMILE SO BIG YOU CAN SEE IT" MBL TROT an Information Instigating a Protest was filed by Senior Stipendiary Steward Mr JM Muirhead against the 4th placing of CREDIT MASTER (Driver Mr AP Neal) on the grounds that CREDIT MASTER broke at the start and galloped in excess of 150 metres.

Rule 870(3) provides that any horse that breaks from its gait during a race shall promptly return to its proper gait.

Part (a) of the Regulations provides : Any horse which breaks from its gait either at the start or during the running of any race and continues on in the break for a distance of 150 metres or greater, shall be deemed to be in breach of Rule 870(3) in that it has failed to promptly regain its proper gait.

Mr AP Neal the Owner and Driver of CREDIT MASTER endorsed the Information to the effect that he did not contest the Protest.

Mr Muirhead demonstrated the incident by use of the race films and showed where CREDIT MASTER broke at the start and galloped in excess of 200 metres.

Submissions for Decision:

Mr Muirhead submitted that CREDIT MASTER was in breach of Rule 870(3) and should be disqualified from the Race.
