As the breach was admitted we find the charge proved.

Penalty:

Accordingly after taking all the above into account and under the provisions of rule 1106 (2) we impose a suspension on Mr Cooksley from riding in races which is to start after racing on 1 January and conclude after racing on 6 January 2012. (4 days)

Facts:

Following race 1 an information was filed pursuant to rule 638 (1) (d). The informant Mr C George alleged that shortly after the start Mr G Cooksley riding BELISARIUS allowed his mount to shift in when not clear of FABRIQUE (Mr L Innes) and ELUSIVE STORM (Mrs T Thornton) both of which had to check.

Submissions for Decision:

Mr George demonstrated the video films which showed BELLISARIUS starting from gate 4. Soon after the start Mr Cooksley allowed his mount to shift in when only a bare length clear of FABRIQUE who was on his inside. Mr George submitted that this caused Mrs Thornton, riding ELUSIVE STORM and who was on the inside of FABRIQUE to take a hold.

Mr Cooksley in admitting the breach said he moved in shaving Mr Innes. He added that GOOD WILL who was on the rail had also moved out slightly contributing to the incident.

Submissions for Penalty:

Mr George said Mr Cooksley had only incurred 1 charge in the last 12 months and he submitted that today’s breach was at the low end.
Mr Cooksley said he had confirmed rides up to and including 1 January 2012.

Upon questioning by the committee he confirmed he only rode in the upper North Island.

Reasons for Penalty:

The committee carefully considered all evidence and submissions. Mitigating factors are Mr Cooksley’s admission of the breach and his excellent record.

The committee finds this breach to be at the low end resulting from an error of judgment on Mr Cooksley’s part, moving in when insufficiently clear.
